Expertise
Jennifer advises private clients from all around the world on succession and tax planning, Wills and powers of attorney and the creation of UK and non-UK trusts.
She is also experienced in advising on family constitutions and the use of partnerships to hold family assets. She regularly advises on ownership structures for liquid assets as well as planes, yachts and works of art and has advised on several very high value art sales, purchases and loans to museums over the last few years.
Jennifer is expert in advising on pre-arrival tax planning for non-domiciled individuals moving to the UK and on the remittance basis of taxation. She regularly sets up excluded property trusts, advises on the most tax efficient way to hold UK real estate and advises on the creation of clean capital for remittance purposes.
Jennifer assists UK domiciled resident clients on Wills and lasting powers of attorney and inheritance and capital gains tax planning. She has helped many families put together suitable succession plans for future generations in relation to UK and cross border situations.
Recent experience includes advising:
- the most efficient ownership structure for a Middle Eastern client to hold valuable UK real estate;
- the creation of a Bahamian trust which is also a US grantor trust;
- cross border succession and will planning involving several European and Middle Eastern jurisdictions and the application of the EU succession regulation; and
- the preparation of a family constitution covering personal and business assets.
She also advises on a wide range of issues affecting charities and other not-for-profit bodies (such as chartered corporations and community interest companies) including constitutional issues, the liabilities of charity trustees and the taxation of charities. She has recently advised on the incorporation of a major grant-making charity thereby reducing the trustees’ risk of personal liability.
She has particular expertise in advising on international charity matters and has advised many clients on the legal and compliance aspects of international grant-making by UK charities. She has also been involved in setting up a number of dual registered charities which are tax efficient for donors in other parts of the European Union and in the United States and in setting up “friends of” organisations in the UK which support charities overseas.
Jennifer also has many years of experience in advising banks and corporate clients on their CSR programmes and on their rights and obligations when contracting with charitable counterparties.
Jennifer has assisted a number of charity clients with investment management agreements and with tailored investment products for charities.
Recent experience includes advising on:
- the creation of an English charitable foundation taking into account the UK tax and remittance implications for the founders;
- the law relating to overseas grant-making and advising on the application of these rules in the context of an arbitration; and
- the scope and effect of founder rights in charitable foundations; the creation of US/UK dual registered charities;
- grant agreements (including their negotiation) for a range of donors and charity clients;
- the merger and incorporation of various charities; and
- charity policies in areas such as grant making, investment, reserves, safeguarding and risk management.
