Emma-Jane has a broad and diverse private wealth practice. Her key specialism is advising non-domiciled clients on UK tax and estate planning matters, particularly when they are planning their arrival to (or departure from) the UK. She regularly advises on the implications of becoming tax resident in the UK and works closely with remittance basis users on how to structure their affairs appropriately. She has extensive experience of advising on the establishment of trusts, foundations and other asset holding vehicles.
Emma-Jane has a particular interest in advising UK and international clients on the legal, tax and practical issues associated with buying, selling and owning (and the import/export) of valuable artwork in the UK. She was recently highly rated by the Legal 500 Directory for her art and heritage property work with individuals, galleries and museums. She also advises regularly on the private client aspects of residential property transactions.
In addition, Emma-Jane has a traditional domestic practice, advising UK clients on inheritance planning, Wills, lasting powers of attorney and UK trust law matters, as well as philanthropy generally. Emma-Jane has a holistic approach to advising her clients and will engage and liaise with banking, accounting, insurance and recruitment professionals and project manage the advice required on family law, real estate, employment and corporate tax issues.
Emma-Jane is a key member of the Philanthropy and Charity team, advising operating and grant-making charities in the arts and educational sectors and a range of religious and cross-border charities on legal and governance issues.
She has a particular interest in the taxation of the charities, especially those with an international dimension. Recent experience includes:
- advising the creators and funders (particularly non-domiciled individuals) on the establishment of charitable vehicles which take a range of constitutional forms (depending on the client’s objectives);
- advising on the establishment of “charitable incorporated organisations”, an entirely new creature of statute;
- the establishment of a number of US/UK dual registered charities and advising on the impact of EU law in the charities sphere;
- advising trustees on day-to-day management issues such as appointment and retirement, remuneration, personal liability and protection and powers and duties generally;
- advising individuals and private banks on probate and post-death issues with a charity law angle;
- working closely with financial institutions on their investment offerings and services to the charity sector; and
- working with charity clients when faced with inter-trustee disputes or complications regarding charitable gifts and bequests.
Emma-Jane also has a wealth of first-hand experience on the operational management of charities, having previously worked in-house for an international grant making foundation. She is also a trustee of a mental health charity which provides practical, emotional and therapeutic support for girls and young women.

The combination of Emma-Jane’s diverse private wealth practice and her commercial skill set has resulted in her advising on a broad range of trust, private tax and charity-related issues but in a commercial context.
Recent experiences include:
- advising on inheritance tax and charity law issues relating to share trusts established to hold special purpose vehicles;
- negotiating with HMRC on the inheritance tax treatment of escrow arrangements;
- advising on the trust taxation aspects of a senior management acquisition of a stake in an asset management business; and
- advising trustees on the construction of trust provisions including the exercise of voting rights and scope of investment powers.
Emma-Jane advises chartered corporations on constitutional, governance and other matters and has a wealth of experience advising on Privy Council issues in the context of chartered bodies.
Emma-Jane provided charity law advice in relation to the sale of the entire education business of the College of Law to investment house, Montagu Private Equity.
One of the key features of Emma-Jane’s practice is assisting clients with their arrival to the UK and, as an integral part of this, she advises on all of the legal and practical aspects of the immigration process to ensure that her clients (and their spouses and dependents) obtain the relevant permissions to enter the UK.
She has particular experience advising individuals from all over the world as well as private banks and other financial institutions on visa requirements, but also advises regularly on the immigration issues relevant to EEA nationals and skilled workers coming to the UK.
