Clare has extensive experience of advising individuals, executors, trustees and beneficiaries on their relative rights and responsibilities and has particular interest in and knowledge of mental capacity issues.
Clare is the “go to” person who knows when specialist advice is needed or when a view can safely be taken and, where necessary, will work with the chosen experts in any particular field to try to help achieve the best possible outcome. In addition to the preparation of Wills, lasting powers of attorney, trust documents and general estate planning work, Clare has a wealth of experience advising personal representatives and beneficiaries of both domestic and cross-border estates on their respective rights, powers and duties.
Clare also has a particular interest in mental capacity issues. She has advised extensively on the tests applicable to different acts and over the years, has had frequent involvement with The Office of the Public Guardian and with the Court of Protection.
Expertise
Clare’s recent experience includes:
- Dealing with the estate of an UHNW individual with complex global assets and holding structures in a multitude of jurisdictions
- Dealing with the estate of an UNHW individual with extensive agricultural and business interests and advising on the reliefs available, significantly mitigating the family’s exposure to IHT
- Advising on highly complex post death arrangements to restructure the devolution of an estate to secure the maximum reliefs available while maintaining family harmony
- Acting for Attorneys of an LPA in their successful applications to the Court of Protection for consent to make a statutory Will and significant gifts out of the patient’s resources
